How to Check Oregon Assisted Living Violations: A Guide for Concerned Families

zeth@greatnessdigital.com March 20, 2024

Placing a loved one in an assisted living facility is a significant decision. Ensuring the facility offers a safe, caring, and high-quality environment is paramount.  A crucial step in this process is checking the assisted living community’s violation history.

This article outlines how to find assisted living violations in Oregon, but the general principles apply to most US states.

Looking for a specific assisted living facility in Oregon? Use this link and search for current and past violations.

*A quick note: From our experience it’s VERY important to understand that not all official violations should be taken as serious. Many good assisted living providers have had accidents that happen when taking care of the elderly but violations are still reported despite many safeguards in place.

Why Check Assisted Living Violations?

Violations can indicate potential problems with resident care, staffing levels, or facility maintenance. They can range from minor administrative issues to serious health and safety concerns. Reviewing an assisted living facility’s violation history offers valuable insights into the quality of care provided.

State Resources:

Each state has its own agency responsible for licensing and inspecting assisted living facilities.  In Oregon, the Department of Human Services (DHS) plays this role, with the Services for Seniors & People with Disabilities (SSPWD) sub-department overseeing assisted living facilities:

How to Find Violations on the Oregon DHS Website:

  • Visit the Oregon DHS website: https://www.oregon.gov/dhs
  • Navigate to the Long Term Care section.
  • Look for a section on Facility Inspections and Enforcement Actions. This section may vary by state, but it typically allows you to search for assisted living facilities by name and view inspection reports containing any cited violations.

Understanding Violations:

  • Severity: Pay close attention to the violation’s severity. Minor administrative issues may be less concerning than violations related to resident care or safety.
  • Trends: A single minor violation may not be a major concern, but a history of repeated violations could indicate a systemic problem.
  • Date of Report: More recent reports provide the most up-to-date information on the facility’s compliance.

Additional Tips:

  • Contact DHS (Aging & Disability Services): Don’t hesitate to contact the DHS directly if you have questions about a specific violation or the inspection process.
    • Your One Stop Shop for All Senior Resources: We are particularly huge fans of Oregon’s initiative to make a single point of contact for all things “seniors” related called the ADRC of Oregon.  Contacting them will always point you in the right direction and short-cut most processes.
  • Beyond Violations: While checking violations is vital, it’s not the only factor to consider. Here are some additional resources:
    • Facility Tours: Schedule a tour and meet with staff to get a firsthand impression of the environment.
    • Resident Reviews: Online review sites can provide valuable insights from past residents and families.
    • Talk to Residents and Families: Engaging with current residents and families offers perspectives on the quality of care.

Reporting Suspected Violations:If you suspect current violations at an assisted living facility, here are some steps you can take:

  • Talk to Staff: Discuss your concerns directly with the assisted living facility staff.
  • Local Senior Services: Contact your local senior and disability services case manager’s office.
  • Oregon’s Ombudsman: In more serious situations, reach out to Oregon’s Ombudsman office for assistance.

By combining a thorough review of violation history with these other resources, you can make an informed decision about the right assisted living facility for your loved one.
